The fee leviable in the case of a Probate (Article 6) on the amount or value of any debt or security specified in the certificate under Section 374 of the act and one and a half times this fee on the amount or value of any debt or security to which the certificate is extended under Section 376 of the Act.
Suit for Declaration
In a suit for a declaratory decree or order whether with or without consequential relief, not falling under section 25 where the prayer is for a declaration and for possession of the property to which the declaration relates, fee shall be computed on the market value of the property or on {rupees one thousand} whichever is higher; where the prayer is for a declaration and for consequential injunction and the relief sought is with reference to any immovable property, fee shall be computed on one-half of the market value of the property or on {rupees one thousand}, whichever is higher. In other cases, whether the subject matter of the suit is capable of valuation or not fee shall be computed on the amount at which the relief sought is valued in the plaint or on {rupees one thousand} whichever is higher.
Adoption Suits
In a suit for declaration in regarding to the validity or invalidity of an adoption or the factum of an adoption, fee shall be payable at the following rates. In a court of Munisiff 2{xxx} when the market value of the property involved in or affected by the relief does not exceed Rs.5,000- Rupees Twenty five. In the court of 3{Munisiff} when the market value of the property involved in or affected by the relief exceeds Rs.5,000 and in any Court other than the courts specified in (a) {xxx}-Rupees one hundred if the market value of the property involved in or affected by the relief is Rs. 15,000 or less and rupees two hundred and fifty if it is above Rs.15,000.
Partition Suit
Rupees 15 if the value of the Plaintiff’s share is rupees 3,000 or less. Rupees 30 if the value is above rupees 3.000 but not more than 5,000. Rupees 100 if the value is above 5,000 but below rupees 10,000.. Rupees 200 if the value is rupees 10,000 and above.
